The general rental conditions may be subject to change. The applicable conditions are those in force on our websites at the time the reservation is made. GENERAL RENTAL CONDITIONSArticle 1: Booking ski and/or snowboard equipment rental Article 2: Provision and return of rented ski and/or snowboard equipment – Rental period Article 3: Use of rented ski and/or snowboard equipment Article 4: Availability of ski and/or snowboard rental equipment Article 5: Breakage cover for skis and/or snowboards Article 6: ATV breakage warranty Article 7: Cancellation conditions Article 8: Personal data Article 9: Jurisdiction – Applicable law ARTICLE 1: RENTAL RESERVATION FOR SKI AND/OR SNOWBOARD EQUIPMENT1-1 : RENTAL EQUIPMENTAll the ski and/or snowboard equipment available for hire is described on our website, with the proviso that the customer can book either a category of equipment (standard offer) or a particular model, subject to the skier’s height, size and weight having been entered when booking a particular model and subject to availability. As the proposed selection is based on the choice of equipment, it is available for booking up to 7 days before the customer’s departure. 1-2: RENTAL COSTSThe cost of the rental is determined by the category of equipment booked by the customer and the rental period chosen in accordance with our rental rates shown in the “Ski rental” section of our website. Our prices include all taxes at the rate in force at the time of booking. This cost is lower than the public rates displayed in our store (excluding handling fees and the option of a breakage guarantee). 1-3 : PAYMENT METHODS1-3-1 SECURE PAYMENT BY CREDIT CARDFB Freeride has entered into a service agreement with Banque CIC concerning e-commerce, called “Monetico”. The purpose of this agreement is to provide all the functions necessary for the management of a payment service and the secure acquisition of payments over the Internet. Monetico manages the security of exchanges and ensures the protection of secrets (decryption keys) and their management. Only bankcards issued by international networks approved by GIE Cartes Bancaires are accepted. Any financial charges (bank charges linked to the exchange rate, bank commission for payment transactions carried out outside the territory where the bank card is issued, other bank commissions, etc.) linked to bank card payments will be borne by the customer. These costs correspond to any charges levied exclusively by the customer’s bank for the use of his/her bank card. The agreement of the central credit card network makes the order validated by the customer on the website. In the event of refusal by the central credit card network, our company reserves the right to cancel the reservation. During the payment transaction, the customer is automatically connected to the server of the payment processing center. Bank details, which are protected by encryption, do not pass through FB Freeride’s systems and are therefore not stored by us. 1-4: CONTRACT FORMATIONThe reservation is concluded and only becomes effective once FB Freeride has received the total amount of the rental, as stated above, and the customer has received an electronic message confirming the rental, including the Exchange Voucher to be printed and presented by the customer to the FB Freeride store. ARTICLE 2: PROVISION AND RETURN OF RENTED EQUIPMENT – RENTAL PERIODThe rental period begins as soon as the customer takes possession of the equipment in the FB Freeride store and ends on the day the equipment is returned, in accordance with the duration indicated on the Exchange Voucher, printed by the customer and given to the selected FB Freeride store. Equipment can be collected from 5pm on the day before the first day of ski hire and returned at the end of the last day of hire or by 10am the following day. No online reservation can be made less than 48 hours in advance, as the store cannot guarantee that the equipment will be ready. Any equipment returned after 10 a.m. on the day following the day of return specified on the Exchange Voucher will be invoiced by the FB Freeride store for one day’s rental at the rates displayed in the store. Rental equipment is the sole responsibility of the customer from the moment he takes possession of it. He/she must take care of it and use it in all circumstances, behaving as a good father of the family. The person renting the equipment is responsible for taking possession of it. In the event of a delay in collecting the rented equipment, the customer must inform the FB Freeride store as soon as possible. Reserved equipment will be held for the customer for 24 hours. Once this period has elapsed, the equipment will be released for rental, without any compensation being due to the customer. Rented equipment must be returned to the FB Freeride store where it was picked up. Failure to return the rented equipment, for whatever reason, will result in the store invoicing the customer for the full new value of the equipment at the public sale price, in addition to the cost of the rental. The customer may protect himself against the risk of breakage by subscribing to the “breakage” guarantee (article 5) at the time of booking. ARTICLE 3: USE OF RENTED EQUIPMENTThe equipment rented is intended for the customer’s use only, with no possibility of subletting or lending, even free of charge. The customer is the sole judge of his or her ability to use the rented equipment. He/she certifies that he/she is fit to use the rented equipment and undertakes to use it carefully, without danger to third parties, in accordance with current regulations. All equipment offered for hire is acknowledged to be taken in good condition and must be returned as such. The equipment, being numbered or marked, must be returned with the same numbers and the same mark. Any deterioration, whatever the cause, will give rise, in addition to the cost of the rental, to payment directly to the store of the cost of replacement or repair, up to the maximum value of the equipment when new. The customer may protect himself against the risk of damage by taking out a “breakage” guarantee when booking (article 5). ARTICLE 4: AVAILABILITY OF RENTAL EQUIPMENTFB Freeride cannot be held responsible for delays in the availability of rented equipment caused by reasons beyond its control, in particular accidents, delays in the return of equipment from previous rentals, changes in regulations, force majeure, strikes, etc…. In such circumstances, FB Freeride will make its best efforts to provide the customer with equipment of equal or higher quality, depending on the store’s available stocks. ARTICLE 5: “BREAKAGE/CHARGE” GUARANTEE for skis and/or snowboardsAt the time of booking, the customer has the option of guaranteeing the ski and/or snowboard equipment rented against damage (total or partial damage to the ski equipment). The cost of this guarantee depends on the category of equipment booked by the customer and the rental period chosen, in accordance with the rates displayed in the store. Forgotten, lost or replaced ski equipment during the entire rental period is not covered. Customer’s obligations in the event of a claim : In the event of damage to ski equipment, the customer must return the damaged equipment to the store where it was rented. ARTICLE 6: ATV “BREAKAGE/CHARGE” GUARANTEEWe do not offer breakage coverage for mountain bike rentals. Damage to mountain bikes is the responsibility of the customer. ARTICLE 7: CANCELLATION CONDITIONS SKI AND SNOWBOARD HIREThe customer has a cooling-off period of 14 clear days from confirmation of the booking. However, this right of withdrawal cannot be exercised if the rental has begun before the expiry of the fourteen-day period. 7-1: EXERCISING THE RIGHT OF WITHDRAWALIf the right of withdrawal is exercised within the 14-day period, the sums paid by the customer will be reimbursed, less a handling fee of €5 per person, including VAT. The refund will be made by crediting the credit card used for the transaction. Apart from cases of withdrawal, cancellations do not give rise to a refund, whatever the reason given (pandemic, government directives, etc…) but may be the subject of a credit note. 7-2: CANCELLATION BEFORE PICK-UP AND AFTER THE WITHDRAWAL PERIODCancellations up to and including D-10 will result in reimbursement of the rental price and of any breakage cover, less a 3% cancellation fee. Any cancellation between D-9 and D-7 inclusive will result in the reimbursement of the rental and of the breakage guarantee if this has been taken out, minus a 50% cancellation fee. After D-6, no cancellations will be accepted and no refunds will be made. 7-3: CANCELLATION AFTER PICK-UPIn the event of illness or accident during the rental period, the rental conditions remain applicable. Only equipment rented by the person concerned may be returned, and will then be invoiced pro rata to the number of rental days actually used (on presentation of a medical certificate and a certificate of return of equipment issued by the store). In this case, the refund (minus a €1 handling fee per person) will be made by crediting the credit card used for the transaction. No refunds will be made for rental days that have already begun. 7-4: CANCELLATION DUE TO WEATHER CONDITIONSIn the event of total closure of the ski area due to weather conditions, which is normally accessible from the equipment rental location, and only in this case, the rental days concerned will be reimbursed on presentation of a receipt issued by the resort’s lift company. In this case, the refund will be made by crediting the credit card used for the transaction. ARTICLE 8: PERSONAL DATAThe customer must refer to the “Legal information” section of the present site. ARTICLE 9: JURISDICTION – APPLICABLE LAWIn the event of any dispute relating to the present contract, and failing amicable settlement, the dispute will be settled by the competent court in accordance with the applicable rules of procedure. French law will be exclusively applicable to any dispute, whatever its nature, and the French courts will have exclusive jurisdiction. FB FReeride |
